Liability Waiver Notice
Section 1 – Introduction
This Liability Waiver Agreement (“Agreement”) is entered into by and between “Parent/Guardian” and Big Brainbox, LLC for the participation of Parent/Guardian’s children (“Participant”) in the Science & Technology activities at Big Brainbox locations.
Acknowledgment of Risks
The Parent/Guardian acknowledges that participation in activities at the Center involves inherent risks, including but not limited to physical injury, property damage, and other potential hazards. The Parent/Guardian voluntarily assumes all risks associated with the Participant’s involvement in the camp.
Acknowledgment of Risks from Augmented Reality (AR) and Virtual Reality (VR) Use. The Parent/Guardian acknowledges that the use of Augmented Reality (AR) and Virtual Reality (VR) technologies involves specific risks, including but not limited to:
- Motion Sickness: Participants may experience dizziness, nausea, or disorientation while using AR/VR equipment.
- Eye Strain: Prolonged use of AR/VR devices can cause eye strain or discomfort.
- Physical Injury: Participants may be at risk of tripping, falling, or colliding with objects or other individuals while immersed in AR/VR experiences.
- Emotional Distress: Some AR/VR content may be intense or immersive, potentially causing emotional distress or anxiety.
The Parent/Guardian voluntarily assumes all risks associated with the Participant’s use of AR/VR technologies during camp activities.
Release of Liability:
In consideration of the Participant being allowed to attend and participate in the activities, the Parent/Guardian, on behalf of themselves and the Participant, hereby releases, waives, discharges, and covenants not to sue the Big Brainbox, LLC, its directors, officers, employees, agents, and volunteers (collectively, “Released Parties”) from any and all liability, claims, demands, actions, and causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by the Participant or the Parent/Guardian, or to any property belonging to them, whether caused by the negligence of the Released Parties or otherwise, while participating in in any activities at Big Brainbox locations.
Indemnification:
The Parent/Guardian agrees to indemnify and hold harmless the Released Parties from any loss, liability, damage, or costs, including court costs and attorneys’ fees, that may incur due to the Participant’s participation in the activites, whether caused by the negligence of the Released Parties or otherwise.

Section 2 –┬аMedical Authorization
The Parent/Guardian grants permission to the Camp to authorize emergency medical treatment for the Participant in the event of an accident or illness during the camp. The Parent/Guardian agrees to be responsible for any medical expenses incurred as a result of such treatment.
Emergency Procedures
In the event of a medical emergency, the following procedures will be followed:
1. Immediate Response┬аStaff will assess the situation and provide first aid as necessary. Program Leads are trained in basic first aid and CPR. The Participant will be moved to a safe location if necessary, ensuring they are comfortable and stable.
2. Emergency Services┬аIf the situation requires further medical attention, emergency services (911) will be contacted immediately.┬аStaff will provide emergency responders with all relevant information, including the Participant’s medical information and the nature of the emergency.
3. Parent/Guardian Notification┬аThe Parent/Guardian will be notified as soon as possible using the emergency contact information provided. Staff will provide detailed information about the incident, the Participant’s condition, and the steps being taken.
4. Transportation┬аIf the Participant needs to be transported to a medical facility, a staff member will accompany them until the Parent/Guardian arrives.┬аThe staff member will bring the Participant’s medical information and any necessary documents to the medical facility.
5. Follow-Up Care┬аThe Camp will follow up with the Parent/Guardian to check on the Participant’s condition and provide any additional support or information needed.┬аAn incident report will be completed, detailing the nature of the emergency, actions taken, and any follow-up required.
6. Documentation┬аAn incident report will be completed, detailing the nature of the emergency, actions taken, and any follow-up required.┬аThe report will be kept on file and a copy will be provided to the Parent/Guardian upon request.
Section 3 – Behavioral Expectations
The Parent/Guardian acknowledges that the Participant is expected to adhere to the center’s code of conduct and safety guidelines. The following behavioral expectations are set to ensure a safe, respectful, and productive environment for all participants:
Respect:┬аParticipants must show respect for fellow campers, staff, and camp property at all times. This includes listening to instructions, using polite language, and treating others with kindness.
Participation:┬аActive participation in all scheduled activities and workshops is required. Participants should arrive on time and be prepared to engage in the day’s events.
Safety:┬аParticipants must follow all safety guidelines and instructions, especially during experiments and hands-on activities. This includes wearing appropriate safety gear and handling equipment responsibly.
Inclusivity:┬аThe camp promotes a positive and inclusive environment. Bullying, harassment, or any form of discrimination will not be tolerated.
Responsibility:┬аParticipants are responsible for their own belongings and are expected to keep their work areas clean and organized. Any violation of these behavioral expectations may result in disciplinary action, including dismissal from the camp without refund.
Media Release:┬аThe Parent/Guardian grants permission for the Participant to be photographed or filmed during the activities for promotional purposes. These images and videos may be used in publications, social media, and other promotional materials. If the Parent/Guardian does not consent, they must notify in writing ahead of the participation.
Governing Law:┬аThis Agreement shall be governed by and construed in accordance with the laws of the state of Texas, without regard to its conflict of laws principles. This Agreement constitutes the entire agreement between the parties and supersedes any prior understandings or agreements, whether written or oral, regarding the subject matter of this Agreement. By signing below, the Parent/Guardian acknowledges that they have read, understood, and agree to the terms and conditions of this Liability Waiver Agreement.
